Steven Senne/AP BOSTON -- Companies that help Target process payments could face millions of dollars in fines and costs resulting from the unprecedented data breach that struck the retailer during the holiday shopping season. Investigators are still sorting through just how thieves compromised about 40 million payment cards and the information of about 70 million Target (TGT) customers. But people who have reviewed past data breaches believe Target's partners could face consumer lawsuits and fines that payment networks such as Visa (V) and MasterCard (MA) often levy after cybersecurity incidents. Target's partners "have deep pockets and are intimately involved in certain aspects of how Target gets paid," said Jamie Pole, a cybersecurity consultant in Asheboro, N.C., who works for government agencies and the financial industry. Fines and settlement costs could reach into the millions of dollars for individual companies, he said, though much will depend on how the ultimate liability for the breach is determined. Boston attorney Cynthia Larose of Mintz Levin said Target would likely seek to add its partners as defendants to lawsuits already filed over the breach. "These class-action lawsuits start to bring everyone in at some point," she said. After its systems were penetrated by hackers in the mid-2000s, retailer TJX Cos. (TJX) agreed to pay up to $40.9 million to cover fraud costs in a settlement with Visa. Visa also issued penalties of $880,000 against Fifth Third Bancorp (FITB) of Ohio, which processed transactions for TJX. Asked about the business relationships and possible costs, Target spokeswoman Molly Snyder declined to comment, citing the ongoing investigation and pending suits. A Visa spokeswoman declined to comment. A MasterCard spokesman said the company couldn't discuss an ongoing investigation. - [By Jonas Elmerraji]
Cloud software provider ChannelAdvisor (ECOM) has enjoyed a stellar run since its IPO earlier this year. In the months since ECOM started trading at the beginning of the summer, shares have nearly doubled. But this stock could be headed for even higher ground before the calendar flips over to 2014.
That's because ECOM is currently forming an ascending triangle pattern, a bullish price setup that's formed by a horizontal resistance level above shares at $40 and uptrending support to the downside. Basically, as ECOM bounces in between those two technically significant price levels, it's getting squeezed closer and closer to a breakout above resistance. When that happens, we've got a buy signal in shares.
ChannelAdvisor has shown investors excellent relative strength all the way up this year, but it's worth noting that the uptrend in ECOM's relative strength line has remained intact even while the ascending triangle has been forming that's a big sign of strength in this market. I'd recommend buying on a move through $40, from there, keep a protective stop at the 200-day moving average.

On Tuesday, small cap biotech stock Kythera Biopharmaceuticals Inc (NASDAQ: KYTH) surged around 25% after announcing that its ATX-101 REFINE-1 and REFINE-2 Phase III trials met all primary and secondary endpoints for the reduction of so-called double chins; but if investors missed out on that rally, small caps Zeltiq Aesthetics Inc (NASDAQ: ZLTQ), Solta Medical Inc (NASDAQ: SLTM) and Cynosure, Inc (NASDAQ: CYNO) each have a piece of the aesthetic market as well. In the case of Kythera Biopharmaceuticals, its ATX-101 can be injected to deal with double chinsmeaning its less invasive than liposuction as the drug dissolves fat cells but leaves other tissue alone. Large cap serial acquirerValeant Pharmaceuticals International Inc (NYSE: VRX) is teaming up with activist investorBill Ackman to pursue large cap Botox maker Allergan, Inc (NYSE: AGN), but stocks like Cutera, Inc (NASDAQ: CUTR), Cynosure, Inc (NASDAQ: CYNO), PhotoMedex Inc (NASDAQ: PHMD) and Syneron Medical Ltd (NASDAQ: ELOS)actually offer investors more exposure to the growing anti aging and aesthetics market (Note: See my recent article: These Small Caps Seek to Treat Your Crow Feet and Double Chin (RVNC & KYTH)). To begin with, Valeant Pharmaceuticals International has a wide focus on neurology, dermatology and infectious diseasesbut acquiring the maker of Botox won be its first foray into the aesthetic marketbecause earlier this year, the company completed its acquisition of Solta Medical Inc (NASDAQ: SLTM) -a designer, developer, manufacturer and marketer ofenergy-based medical device systems for aesthetic applications. And whileAllergan, Inc may be most well known for Botox, its actually a pretty bigcompany focused on a diverse range of areas, including ophthalmic pharmaceuticals, dermatology, neuroscience, urology and cosmeticsmeaning the following stocks offer investors better exposure to the aesthetics market:

It is clear that these key metrics match the metrics of a heavily natural gas weighted company that also carries significant debt. To prove this, let's check out Comstock Resources (CRK). Comstock sold some assets recently to Rosetta Resources (ROSE) to reduce its long term debt which still remains high though.
